Lest We Forget
| CRIMINAL LAW CASES:Have You Been Arrested or Being Investigated for a Crime? The most important thing that you need to know when facing criminal charges is that the sooner we are brought into your case to represent you, the sooner we can begin protecting your rights. You may think that is a very arrogant statement to make, but it really isn't. Far too many very honest people, through their own inexperience, are extremely foolish and do not take the initial contact with Police Agencies seriously. They think that they can simply talk themselves out of trouble, without going to the expense of hiring an attorney. Unfortunately they usually just bury themselves deeper in trouble or convict themselves out of their own mouths. That is the reality of the situation that you are facing if you are suspected of committing a crime.
Do You Need a Lawyer? If you are uncertain as to whether or not you need the services of an experienced Criminal Attorney, click on the "Need an Attorney?" button in the upper right corner of your browser. This button will take you to several pages that will help you answer that question for yourself. Although I cannot think of a time where is was more important to have a lawyer than when you are accused of committing a crime.
How Does the Criminal Court Process Work?If you are new to the Criminal Justice System, you will find a brief overview of the entire process, click on the "Criminal Court Process" button located at the left side of the screen for a discussion of the entire process.
Drunk Driving and the DMV Hearing:DUI or Drunk Driving cases and DMV Hearings Procedures have become two distinct and separate subcategories of the Criminal Law Section. For this reason, we deal with these types of cases separately. For detailed information relating to Dui Cases please click on the "Dui Cases" Button to the left. For detailed information relating to the DMV Hearing procedures please click on the "Dmv Hearings" Button to the left.
Your Constitutional Rights:You have a "constitutional right to remain silent," exercise that right and shut up. You do not have to talk to the Police without having your attorney present. The problem for many people is that the first time they actually talk to a lawyer is at their arraignment and by then it may already be too late. The damage may already be done. When you talk to the Police without an attorney present you are taking a "HUGE RISK" even if you are "totally innocent." The reality is that you are not a experienced criminal lawyer trained to deal with such serious situations. If you delay in seeking legal help from a qualified criminal lawyer, you may find yourself facing serious fines, loss of important privileges or even imprisonment. Just because you were arrested or detained by the Police "doesn't mean you are guilty." Mistakes can happen. You may be legally innocent or have a defensible case, which may become "ruined by your inaction." Important evidence which may prove your innocence could be "lost forever." Don't compound your problems, act quickly and contact our office.
Our Capabilities:We can handle your case from the initial investigation and contact with the Police right on through trial if necessary. We have expert witnesses and investigators available to investigate and evaluate every aspect of your case. This allows us to be in the best possible position to present the truth about you and your case to the judge or jury. In an effort to make that presentation persuasive, we have many tools at our disposal to help determine the likelihood of success at trial. We use private investigators to help gather evidence of your innocence. We will investigate your accuser. We will search for and interview any witnesses. Many times percipient witnesses are interviewed and released by the police, without the results of the interview showing up anywhere in a police report. So is it any wonder that when we start looking for evidence of innocence, sometimes we find it. Not to mention that, we may even discover evidence which helps discredit the honesty and credibility of your accuser. When appropriate we use Expert Witnesses, such as a criminalist, to examine and evaluate the prosecution's scientific evidence. They also will prepare defense evidence and will testify in specialized areas within their scientific expertise, such as accident reconstruction, firearm ballistic, fingerprints analysis, forensics, psychiatry, DNA, alcohol & drugs, and other types of evidence. We are also very skilled at pre-trial negotiations which may lead to resolving your case without the expense of a trial. This process is most often referred to as plea or sentence bargaining. While we cannot guarantee a particular outcome, you can be assured that we will represent you to the best of our ability.
Local Knowledge of the Courts:As members of local Bar Associations, we associate with and become familiar with some of the best legal minds in the area. We are also familiar with the local Courts, Judges, Prosecutors and special local rules, which can be tricky for the uninitiated. This allows us to have a better understanding of the particular judicial philosophy, rule or peculiarity that we are likely to encounter in handling your case. It helps prevent you from being "hometowned" by the prosecution. Each Courthouse and each courtroom has its own special sets of rules and problems. Since we are constantly in each of the local courts we get to observe the local judges and commissioners in action. We learn what they are really like from personal observation, we do not rely on what a legal periodical says they are like. Armed with this local knowledge, sometimes we know that a particular judge wouldn't be right for your particular case. If we act quickly we can sometimes have your case moved to another judge that would be better suited for your case.
Multiple Defendants and Other Special Considerations:It is not unusual for someone to have become involved in a case involving friends, family members, or business acquaintances. This can be especially true with Federal cases and cases involving questionable business transactions. When these cases come down, everyone on the defense side is scrambling around trying to figure out exactly what is going on. Everyone involved needs to be quickly represented by a competent criminal attorney who can work well with the other members of the defense teams. That is where local legal relationships built over years can be invaluable. When we are retained in cases involving multiple defendants, if necessary, we are able to quickly assemble a defense team that is second to none. Whatever the need we can provide it for you and at a competitive price. Since we can handle your case through the pretrial or trial stages, you have some flexibility regarding what the defense of your case may cost you. This lets you decide exactly how far you want to go. Coupled with our experience, you are not making decisions blindly. If you decide to just go up to a certain point and then stop, you can. If you feel that you need to present the case to a jury at trial, you can do that too. Of course there is going to be a big difference in the costs, but then you will know that before you make your final decision. No guesswork.
