Divorce and Family Law Cases:

        A Divorce or Family Law Case does not have to be the nightmare of legend. In fact most cases are really unexciting. They would never  even make it on the Jerry Springer show. These cases are about dividing up pots and pans, mending a broken heart and moving on to new relationships.  Most of the really terrible cases are  that way because of the decisions that the parties made during their relationship. The good news is that with a few rare exceptions, it just doesn't have to be that way.

        In an effort to remove the mystery surrounding this area of law, we have revamped our Family Law homepage. We sincerely hope that by doing this, our visitors will be better able to better utilize the information on our site.  Instead of using this page to inform you of our philosophical view on family law, we are now using this page as a guidepost to the various sections that we have concerning family law. However, if you would like a brief "Family Law Overview," then be sure to click on that button to visit that page. There you will find information concerning your rights and responsibilities, as well as our view regarding the handling of family law cases.

        If you would like to know more about the mechanics of how a family law case is handled in the courts, then you should click on "Divorce Court Process" to learn how your case will proceed through the court. We explain who all the players are and what you should expect to happen in court. We explain the differences between an Order to Show Cause Hearing and a Trial. If you want to really know the nuts and bolts of the court process, this is where you should go.

        If you would like to learn about some of the new laws affecting family law, then you will want to visit our page entitled "New Family Laws."   There you will learn what new laws the legislature has enacted and how they may apply to you.  We also try and give a short thumbnail sketch of each law and how it is applied in the real world. Many of our visitors report that they were able to pass along information to friends and family that were going through the divorce process and was not aware of these changes.

        Next you get into the meat and potatoes of family law. The section on "Custody and Visitation" provides much information regarding the entire process of a custody battle.  Make no mistake about it, when custody of your children is at stake, you are in a war. You need to be able to treat the situation like one.  In addition to being an advocate for your rights, we have always prided ourselves in being shrewd tacticians.  being able to figure out a workable game plan that works is more important that just being a skilled litigator. Many custody fights are won or lost on tactics.

        The main event in the custody fight is the Evidence Code Section §730 evaluation. Our site is one of the few family law sites that offers expanded coverage of the 730 evaluation process. We show you how to prepare yourself to participate and win in the evaluation process. To view this page, click on "730 Evaluation" button to the left. There you will find a plethora of useful information regarding this subject. You will also find that we view the 730 process a team effort between the client and their lawyer.

        Next you will find the sections dealing with support issues. We have further broken this down into "Child Support" and "Spousal Support." All support issues are interrelated, however in many cases you may not need to have information regarding child support when you have no children. For this reason we have separated the subject into two separate pages for the benefit of our visitors.

        Given the rampant problem with spousal abuse and other chicanery, we have provided a separate section dealing with "Restraining Orders."  I wish that I could tell you that most people don't need restraining orders, but that would be untrue. Today, most cases have some sort of protective order, ranging from the very severe to orders aimed at just keeping honest people honest. If you have questions regarding whether you need a restraining order and what kind of conduct can be restrained, this is the place to go.

        Restraining orders also involve criminal law.  Today's world is complex, not only may you have a divorce case to worry about, you also may be facing criminal charges relating to violating a restraining order. We also handle criminal cases involving restraining orders. You may want to check out our section on "Criminal Law" if you need a criminal defense attorney.

        The section on "Property Issues" may seem fairly mundane, however I can assure that it isn't. At this section you will find information regarding how one characterizes property and how one divides it. In addition on that page you will find links to "Epstein, Watts, & Jefferies Cases" and "Brown Orders." If you are contemplating divorce or are in a divorce, it is absolutely imperative that you read and understand these concepts. This is especially true if you are representing yourself.

        Of course, if you are undecided if you should represent yourself, I would suggest that you go to the top of the page and click on the button marked "Need an  Attorney," you will be glad you did. Far too many people foolishly think that they can represent themselves or cannot afford an attorney to help them. You should not make such a decision, before you read this article, it is an eye opener.
